IMPORTANT DISTINCTION

The penalties described on this website concern failures to comply with CMA investigative requirements during an inspection.

The separate CMA investigation into suspected bid-rigging remains ongoing.

The CMA has expressly stated that no assumption should currently be made that competition law has been infringed.

OPEN INVESTIGATIONNO INFRINGEMENT FINDING

The CMA launched its investigation in December 2024 into suspected anti-competitive conduct in the supply of roofing and other construction services.

The Scope

  • The inquiry concerns suspected anti-competitive conduct involving roofing and other construction services.
  • The initial focus included schools eligible for Department for Education Condition Improvement Fund funding.
  • The scope was later expanded to include public and private-sector bodies.
  • As of the current CMA record, 12 businesses are under investigation.

The Critical Status

The CMA has expressly stated that no assumption should be made that competition law has been infringed.

The CMA has not yet concluded that M&J engaged in bid-rigging. The investigation remains open. No statement of objections has been confirmed as issued, and no final infringement decision has been made.

What This Is Not

This page does not state that M&J participated in a cartel, rigged school contracts, illegally colluded, defrauded schools, or stole taxpayer money. Those characterisations would require a final authoritative finding that has not been made.

Currently acceptable descriptions include: "M&J is under investigation for suspected bid-rigging," "The CMA is investigating whether M&J and other firms engaged in anti-competitive conduct," and "The investigation remains open."

Possible Outcomes

  • Investigation closed without action.
  • Statement of objections issued.
  • Parties removed from the investigation.
  • Infringement decision with fines.
  • No-infringement decision.
  • Settlement.
  • Appeals and court review.

The CMA has not indicated which outcome will occur.
